Final preparations are underway for the conference in Zurich and the Legal & Liability Committee will be presenting an interesting and varied program for the workshop on Tuesday, 14th September.

 

The workshop will start with presentations by committee members Andrew Bardot and Dieter Schwampe respectively giving an update on the status of various international liability conventions and CMI proposals for compulsory liability insurance in the marine sector.  The BP blowout and ensuing pollution in the Gulf of Mexico has focused attention on exposure to environmental damage and re-ignited the debate over limitation of liability and the ability of the insurance industry to fund the scale of strict liability demanded.  Will sense prevail over a level of limitation that is appropriate to the risks and insurable?

As always we are delighted to welcome guest speakers.  Derek Hodgson, Secretary General of IACS, will give a presentation on the liability of classification societies and discuss the question - "is it a level playing field?".  This will hopefully stimulate an interesting debate given the sometimes polarised views of shipowners, hull underwriters and cargo interests on this subject.

The remainder of the workshop will be devoted to International Trade Sanctions. Reinsurance and direct underwriters are under more pressure than ever to interpret and apply measures concerning international trade sanctions.  This is a an unenviable task with direction and legislation being passed by the United Nations, United States of America and the European Union.  The tentacles are far reaching and the consequences potentially severe for any underwriter that has failed to exercise a reasonable level of diligence in complying.  Peter Crowther of Dewey & LeBoeuf will summarise the latest legal developments and the likely consequence of non-compliance.  Rolf Tanner of Swiss Re will consider the business impacts particularly from the perspective of a reinsurance underwriter transacting business in a number of different jurisdictions.
